Introduction

Welcome to Thanasi Homes. These terms and conditions govern your use of our property management services. By engaging our services, you agree to be bound by these terms.

These terms are effective from the date you first use our services and will continue to apply throughout our working relationship.

If you do not agree to these terms, please do not use our services.

Definitions

Key Terms

"We", "Us", "Our" refers to Thanasi Homes, a property management company based in Leicester, UK.

"You", "Your" refers to the property owner or landlord who engages our services.

"Services" means our property management services, including but not limited to guaranteed rent, property management, maintenance, and tenant sourcing.

"Property" means your rental property that is under our management.

"Agreement" means the management contract between you and Thanasi Homes.

Services Overview

We provide comprehensive property management services designed to give you peace of mind as a landlord. Our services include guaranteed rent payments, full property management, tenant sourcing, maintenance coordination, and compliance management.

We offer guaranteed rent, meaning we pay you a fixed monthly amount regardless of occupancy. This eliminates void periods and payment delays.

Our property management services cover tenant management, rent collection, property inspections, compliance checks, and maintenance coordination.

We have in-house maintenance expertise, including a qualified Gas Safe engineer, which allows us to handle many repairs quickly and cost-effectively.

Service scope may vary depending on your specific agreement with us. We will clearly outline what is included in your management package.

Property Owner Obligations

You must ensure your property is in good condition and complies with all relevant safety regulations before we begin management.

You must provide us with access to the property for inspections, maintenance, and emergency repairs as needed.

You must maintain appropriate insurance coverage for your property, including buildings insurance and landlord liability insurance.

You must disclose any known issues with the property, including structural problems, damp, or other defects.

You must ensure the property meets all legal requirements for rental, including gas safety, electrical safety, and EPC requirements.

You must comply with all local licensing requirements if applicable to your property.

Payment Terms

We pay guaranteed rent monthly, typically on the same date each month as agreed in your management contract.

Rent payments will be made directly to your nominated bank account.

Management fees, if applicable, will be clearly outlined in your management agreement.

Additional service costs, such as major repairs or improvements, will be discussed and agreed with you before work commences.

If you fail to meet your obligations under this agreement, we reserve the right to suspend or terminate services and may withhold rent payments until issues are resolved.

Contract Duration & Termination

The minimum contract period will be specified in your management agreement, typically 12 months.

Either party may terminate this agreement by giving the required notice period as specified in your contract, typically 2-3 months.

Early termination may be possible in certain circumstances, such as breach of contract or mutual agreement.

Upon termination, we will return the property to you in the condition specified in your agreement, subject to fair wear and tear.

Final rent payments and any outstanding fees will be settled within 30 days of termination.

Property Maintenance

We are responsible for coordinating and managing day-to-day maintenance and repairs during the tenancy.

We provide free annual gas safety certificates and boiler servicing for properties under our management.

You remain responsible for structural repairs, major improvements, and any work required due to pre-existing conditions.

Emergency repairs will be handled promptly, and we will inform you of any significant issues as soon as possible.

Planned maintenance will be scheduled at convenient times, and we will keep you informed of any major works.

Costs for maintenance will be allocated according to your management agreement - some may be covered by us, others may be your responsibility.

Compliance & Safety

We provide free annual gas safety certificates and boiler servicing for every property we manage.

We ensure compliance with electrical safety requirements and will arrange necessary inspections and certificates.

We ensure your property meets EPC (Energy Performance Certificate) requirements.

We handle all necessary licensing requirements and will advise you if your property needs a license.

We conduct right to rent checks on all tenants as required by law.

We maintain records of all compliance certificates and inspections.

Liability & Insurance

Our liability is limited to the value of fees paid to us, except in cases of gross negligence or willful misconduct.

You must maintain appropriate insurance coverage, including buildings insurance and landlord liability insurance.

We are not liable for damage caused by tenants beyond normal wear and tear, unless we have been negligent in our management.

We are not liable for events beyond our reasonable control, including natural disasters, pandemics, or government actions.

You agree to indemnify us against any claims arising from your failure to meet your obligations under this agreement.

Data Protection & Privacy

We take data protection seriously and comply with GDPR and UK data protection laws.

We collect and process your personal data to provide our services, manage your property, and comply with legal obligations.

We handle tenant data in accordance with data protection laws and only share information as necessary for service delivery.

You have rights regarding your personal data, including the right to access, correct, or delete your information.

Dispute Resolution

If you have a complaint, please contact us in writing, and we will respond within 14 days.

We aim to resolve all disputes amicably through direct communication.

If we cannot resolve a dispute directly, we may suggest mediation through an independent third party.

These terms are governed by the laws of England and Wales.

Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

General Provisions

We may modify these terms from time to time, and will notify you of any significant changes.

You may not assign this agreement without our written consent.

These terms, together with your management agreement, constitute the entire agreement between us.

If any part of these terms is found to be invalid, the remainder will continue to apply.
